The Department of Labor and Employment (DOLE) of the Philippines has issued Labor Advisory No. 02, Series of 2025, detailing the payment of wages for the special (working) day on 25 February 2025, which marks the EDSA People Power Revolution Anniversary. This advisory is crucial for both employers and employees to ensure compliance with the prescribed wage rules.

Key Points of the Advisory

  1. Ordinary Working Day Consideration:

    • The special (working) day on 25 February 2025 will be treated as an ordinary working day for the purpose of wage payment and related benefits.

  2. No Work, No Pay Principle:

    • If an employee does not work on this day, the no work, no pay principle will apply. However, exceptions can be made if there is a favorable company policy, practice, or a collective bargaining agreement (CBA) that grants payment on a special working day.

  3. Wage Payment for Work Done:

    • Employees who work on this special working day will receive 100% of their basic wage for the first eight hours of work. This is calculated as Basic wage x 100%.

  4. Overtime Payment:

    • For work done in excess of eight hours, employees will be paid an additional 25% of their hourly rate on that day. This is calculated as Hourly rate of the basic wage x 125%.

Conclusion

Employers and employees should be guided accordingly by these rules to ensure proper wage payment and compliance with the labor laws. This advisory not only honors the significance of the EDSA People Power Revolution Anniversary but also ensures fair compensation for employees working on this special day.
