DOLE Pay Rules for Labor Day on May 1, 2025
The Department of Labor and Employment (DOLE) has issued Labor Advisory No. 05, Series of 2025, detailing the correct payment of wages for the upcoming regular holiday on May 1, 2025, in celebration of Labor Day. This guide is based on Proclamation No. 727, Series of 2024, ensuring every Filipino worker is compensated fairly.

Key Pay Rules for the May 1 Regular Holiday
To ensure proper compliance, employers and employees should be guided by the following computations:
1. If You Do Not Work
If you decide not to work on May 1, you are still entitled to receive 100% of your daily wage. This is often called 'no work, with pay'. A condition applies: you must have worked or been on paid leave on the workday immediately preceding the holiday.
Formula: Basic Wage x 100%
2. If You Work on the Holiday
For employees who work on Labor Day, you shall be paid a total of 200% of your basic wage for the first eight hours.
Formula: Basic Wage x 200%
3. If You Work Overtime
Should you work for more than eight hours, you are entitled to an additional 30% of your hourly rate on said day.
Formula: Hourly Rate of the Basic Wage x 200% x 130% x Number of Hours Worked
4. If You Work on a Holiday That is Also Your Rest Day
When your work schedule falls on the regular holiday which is also your scheduled rest day, you will receive an additional 30% on top of the 200% holiday pay.
Formula: Basic Wage x 200% x 130%
5. If You Work Overtime on a Holiday/Rest Day
For overtime work rendered on a regular holiday that also happens to be your rest day, you will be paid an additional 30% of your hourly rate for that day.
Formula: Hourly Rate of the Basic Wage x 200% x 130% x 130% x Number of Hours Worked
